1. Introduction

This Privacy Policy sets out the rules of personal data processing and protection and the manner and rules of use of cookies on the Website.

2. Definitions

Controller – personal data controller (and also the operator of the Website) which is: Elkomtel sp. z o.o. (Ltd.) with a registered office at Smolenska Street 83/98, 03-528 Warsaw, Poland, VAT no PL1132851215.

Data Protection Officer – the Controller has appointed a Data Protection Officer in its organizational unit.

3. Cookies

3.1 Cookies constitute computer data, in particular small text files, which are stored in the User’s end device and are intended to use the Website. Cookies usually contain the name of the website they originate from, the period of their storage in the end device and a unique number. Cookies on the Website help in proper functioning of the service and in gathering data for statistical purposes and for mechanisms providing general knowledge about how the Users use the Website. Cookies are also used by external services to which the Website refers. For instance, displaying or presenting an interactive localization map.

4. Personal data

4.1 The data subject has a right to access the contents of his/her personal data and a right to correct, remove them, limit the scope of their processing, a right to transfer the data, a right to submit an objection, a right to withdraw his/her consent at any time, without any impact on the right to processing which has been done on the basis of such consent before such consent is withdrawn.

4.2 In the event of determination that personal data processing breaches the provisions of GDPR, the User who is such data subject has a right to lodge a complaint to the President of the Personal Data Protection Office.

4.3 For the purpose of using the Website, and in particular for the purpose of filling-in the contact form or the purchase order, the following personal data of the User are processed (depending on the type of the form):
– name
– email
– address

4.4 The settings of external scripts, such as statistics (including Google Analytics), were modified in order to limit, to the minimum possible extent, the risk of a possibility of collecting any additional personal data (e.g. by means of anonymization of IP numbers).

4.5 Users’ personal data may be transferred or disclosed to other entities subject to the rules specified in separate provisions.

4.6 Users’ personal data may be transferred or disclosed by the Controller to other entities solely for the purpose of proper execution of the submitted order. In particular, this applies to online payment processing entities (e.g. Paypal). Transfer or disclosure of Users’ personal data must be done with observation of Users’ rights and according to the binding provisions of law.

4.7 Users’ personal data are processed for the purpose of responding to correspondence transferred via the contact form or for the purpose of fulfilment of the provisions encompassed by such correspondence, and for the purpose of execution of orders submitted via the Website.

4.8 Users’ personal data shall be stored for a period required for the fulfilment of the provisions covered by the contact form or by the purchase order and for a period of 2 calendar year from the date of completion of fulfilment of such provisions.

4.9 The Controller shall protect the Users’ personal data against unauthorized access of third parties, and shall provide organizational and legal means, according to the binding provisions of law, aimed at guaranteeing confidentiality of the Users’ personal data. The Controller shall implement and apply the appropriate technical solutions aimed at the protection of the Users’ personal data.

5. Final provisions

5.1 This Privacy Policy shall come into force on 01 April 2020.

5.2 The Controller reserves the right to amend this Privacy Policy due to important reasons, in particular in the event of a necessity of adjustment of this Privacy Policy to the provisions of law or decisions and judgements of courts or public authority bodies, improvement of the User service or changes resulting from other situations which require such amendment to this document

5.3 An amendment to this Privacy Policy shall not affect the personal data processing before the effective date of such amendment.
